Please read these terms and conditions carefully, in conjunction with ‘YOUR AGREEMENT WITH US’, as they apply to all the accommodation reservations and services described in this website and form part of the contract between us and you. All bookings are made with www.worldoftravelusa.com on the basis of the following conditions and information.

OUR AGREEMENT WITH YOU

1. THE CONTRACT AND CONFIRMATION

The terms and conditions set out in this section together with your confirmation invoice comprise your agreement between www.worldoftravelusa.com and all the people listed on your booking on whose behalf the party leader is acting. World of Travel USA is a trading name World of Travel Inc. located 78 West 47th Street 4th Floor New York, NY 10036 USA

We will accept your reservation when you ask for your booking to be confirmed by submitting an electronic request via our website. However, the contract is not made until the date shown on our confirmation invoice (subject to iv). It is only then that a contract exists.

Although we would not anticipate any costing errors with respect to the advertised price of accommodation and services listed on our website or on the confirmation invoice, should there be an obviously incorrect price shown, we will issue a new invoice and will not be bound by the incorrect price advertised, quoted or displayed on this website or detailed on the incorrect invoice.

If you pay us any sum in order to secure a request for additional accommodation (in particular within six weeks of arrival) this constitutes a commitment to proceed with that booking once your request is confirmed and therefore such monies are non refundable unless your request cannot be fulfilled.

It is important that you check all issued documentation carefully to ensure that they are correct as this forms the basis of the contract. Any discrepancies should be brought to our attention within 48hours of issue otherwise the details shown on the confirmation invoice will be presumed to be correct.

Assuming we are able to confirm your reservation, we will provide electronic access or send your confirmation invoice as soon as possible. This will be made available once we have received your booking confirmation from the our suppliers such as airlines, car rental companies, tour operators hotelier or any third party service provider with whom your booking has been placed. If you do not receive a confirmation invoice within 48 hours of processing your reservation you should contact our customer services team directly to make sure that your reservation has been made–

In the hotel bookings unlikely event that we are unable to confirm your booking we will try to offer you an alternative like accommodation in which case you will be free to: accept the alternative accommodation suggested by us: purchase another accommodation at the current advertised price from us, or: accept a full refund with respect to any monies which you have paid and have been collected by us. You must notify us of your choice in writing, preferably via email, within 48 hours of receiving our offer. If you choose to accept any alternative accommodation arrangements we will provide electronic access or send your confirmation invoice as soon as we have received your written acceptance. This will be made available once we have received your alternative booking confirmation from the hotelier or any third party service provider with whom your booking has been placed. If you do not wish to proceed, we will refund any monies that you have paid to us and that we have collected within 7 days of receiving your written notification of non acceptance.

2. OUR PRICES

All reservations and prices are subject to availability at the time of processing your booking request and we reserve the right to increase or decrease our prices at any time, though the price shown on your confirmation invoice will not increase unless you amend the booking in anyway after it is made (subject to iv – THE CONTRACT AND CONFIRMATION).

At hotel booking Unless otherwise stated the total price displayed at the time of booking relates to the accommodation only price for the number of passengers allocated into the individual rooms as requested on your booking form. Your price may also include any meals with respect to the board basis which you have chosen to confirm and also includes VAT. Prices do not include any additional services such as flights, transfers or travel insurance. Prices do not include any local charges, additional taxes or incidental charges for services which you choose to undertake locally in your destination the season it may be necessary on certain dates to purchase extra accommodation which may mean an increase in cost being passed to you as we cannot always negotiate the same favorable seasonal rates. Such charges will be advised to you at the time of booking.

3. CANCELLATION AND ALTERATIONS BY US ON ACCOMMODATIONS

Due to the nature of travel arrangements and the fact that we plan accommodation programmes many months in advance, it is sometimes necessary to make changes to arrangements as described in this website or listed on your confirmation invoice. Therefore, we must reserve the right to change or cancel travel arrangements after we have entered into the contract.

If we, your hotelier or any third party accommodation provider who we are acting on behalf of makes a change or cancels your reservation then we will notify you as soon as possible. Changes can occur due to a variety of reasons including overbooking, building work, refurbishment, lack of demand, force majeure or events which are beyond our control.

If we, your hotelier or any third party accommodation provider alters your booking any way then you will be free to accept any alternative accommodation or service offered by us, your hotelier or third party accommodation provider without compensation or, accept a replacement accommodation or service arrangement from us of equivalent or very closely similar standard and price, if one is available (together with a refund of any price difference if the new arrangements are of a lower standard and price ..::.. without compensation); or cancel your accommodation arrangements with us and receive a full refund of any monies paid to and collected by us ..::.. without compensation.

Your must notify us of your choice within 48 hours of our offer in writing, preferably via email so that we can reconfirm your alternative arrangements on your behalf or make suitable arrangements to cancel your reservation and apply a full refund of any monies that you have paid to us.

We also reserve the right as does your hotelier and third party accommodation provider, to cancel your reservation and terminate the contract immediately without refund prior to your arrival or whilst you are in resort should we feel that your behavior towards any of our staff, our agents, associated companies, hoteliers, third party accommodation providers, their staff or other guests staying in your accommodation be deemed improper or abusive.

4. OVERBOOKING

In the event that your hotelier or third party accommodation provider are unable to provide the accommodation arrangements that we have reserved with them on your behalf and where we have not been notified of the situation prior to your arrival in resort, you shall on arrival be offered alternative accommodation where possible by the hotelier or third party accommodation provider with or without compensation. Any offer of alternative accommodation arrangements and forms of compensation will be made to you directly at the discretion of the hotelier or third party accommodation provider. You will also have the option to not accept their offer of alternative arrangements and may cancel your reservation directly with the hotelier or third party accommodation provider and receive a full refund of any monies paid to and collected by us with respect to your booking.

If you choose to accept any alternative accommodation arrangements then you will be required to sign a disclaimer locally in resort to confirm that you have accepted their offer and that no further action will be taken against the hotelier, third party accommodation provider or us. This also applies to canceling your reservation without penalty and receiving a full refund of any monies that you have paid to us. Failure to follow this procedure and comply with this request will result in us not being able to reclaim your refund from the hotelier or third party accommodation provider for your reimbursement.

5. COMPENSATION

Any offers of compensation will be made directly to you by the hotelier or by the third party accommodation provider who is responsible for providing your reservation. It will remain your responsibility to negotiate, secure, accept or decline any offer of compensation that may be offered to you by the hotelier or third party accommodation provider locally, whilst you are in resort. Should you successfully negotiate a claim for compensation against your hotelier or the third party accommodation provider who is listed in the Reservation is Guaranteed and Payable by section on your pre-paid accommodation voucher whilst you are in resort, and choose to accept their offer, you will be required to sign a disclaimer locally in resort to confirm your acceptance and that no further action will be taken against the hotelier, third party accommodation provider or us. Failure to follow this procedure and comply with this request will result in us not being able to reclaim any monetary compensation from the hotelier or third party accommodation provider on your behalf.

6. FORCE MAJEURE

We accept no liability and offer no compensation or recompense should we have to cancel or change your accommodation arrangements in any way due to war, riot, industrial or civil dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other unforeseen circumstances that may amount to Force Majeure.

7. OUR LIABILITY TO YOU

World of Travel USA is a trading name of World of Travel Inc. Inc and act as retail distribution agents for third party accommodation providers who choose to distribute their inventory and products via this website and through www.worldoftravelusa.com As acting retail agents our liability and responsibility to you will remain limited to the extent of passing your booking request onto your accommodation provider for confirmation. On receiving their confirmation it is our responsibility to ensure that the reservation details that you have requested are confirmed on your behalf with the third party accommodation provider with whom your reservation has been placed, subject to these terms and conditions of booking. The proper performance of accommodation services is the sole responsibility of the hotelier and the third party accommodation provider with whom your reservation has been placed.

We shall not accept any liability to you for any loss of profits, administrative inconvenience, anticipated savings, disappointment, wasted expenditure, additional expenditure, direct or indirect loss or damage, corruption or destruction, illness, personal injury, death or loss of any kind caused or alleged to have been caused by the use of this site, the information contained herein, or the use of any service provided by us. Any claim for compensation, damages or refunds must be brought by you directly against the owner of the accommodation or the third party accommodation provider listed in the ˜Reservation” Guaranteed and Payable by section of your accommodation voucher and will be under the jurisdiction of the law in the country in which the hotelier or third party accommodation provider is based.

8. CONTENT DISCLAIMER

We do not guarantee the accuracy or completeness of any information contained in or provided in connection with information, accommodation or services advertised or listed within this site. The information which is displayed on this site is derived from a number of external sources and although most suppliers and content providers take great care in trying to ensure literature and content accuracy, the nature of information delivered within this site may not be free from errors or omissions and services or facilities may change or be withdrawn without our prior knowledge and this literature may also change from time to time. We strongly advise that you inquire whether any changes to the information contained in our site with respect to the accommodation and services provided have been notified to us before you book your chosen accommodation or service.

We shall not accept any liability to you for any loss of profits, administrative inconvenience, anticipated savings, disappointment, wasted expenditure, additional expenditure, direct or indirect loss or damage, corruption or destruction, illness, personal injury, death or loss of any kind caused or alleged to have been caused by your use of this site, the information contained herein or otherwise presented to you through the site or the use of any service provided by us. We furthermore accept no liability should the service that we have confirmed on your behalf not live up to your personal expectations due to the information presented to you via this site.

YOUR AGREEMENT WITH US

1. BOOKING YOUR ACCOMMODATION ARANGEMENTS AND SERVICES

When you wish to confirm your booking you must pay either a non refundable deposit to secure your reservation at the time of processing your booking or if your booking transaction date is within six weeks of the commencement of service then you will be required to pay the full amount.

On some occasions should you wish to take advantage of and confirm what may be deemed as a specially negotiated deal, special offer or promotion, it may be necessary for you to secure your reservation by paying the full amount at the time of processing your reservation.

The required payment to secure your reservation will be made known to you at booking stage via our website and all bookings processed are subject to our cancellation policy, amendment policy, important information and these terms and conditions of booking.

Bookings for young persons under the age of eighteen years old will not be accepted unless one member of the traveling party is eighteen years old at the time of booking, is the lead name on the booking and is the credit card holder that pays for the reservation. It is also a requirement that the parent or guardian of any minors traveling in a young party provide written authorization to us giving their legal consent for their minor to travel.

It is a requirement that you and all members of your traveling party have full travel insurance in place to cover them against every eventuality including cancellation and curtailment cover as well as full medical cover prior to processing a reservation with us. We strongly recommend that you take out insurance prior to processing your reservation and you agree to indemnify us against any claims or losses incurred as a result of you or any member of your party not being insured or being inadequately insured with respect to your booking. If you party not being insured or being inadequately insured with respect to your booking. If you already have travel insurance in place then please check your policy carefully prior to confirming your reservation to ensure that it covers you for the travel services that you are confirming. If your cover is insufficient then you travel at your own risk.

Upon us accepting your reservation and issuing our confirmation invoice to you, unless any discrepancies are brought to our attention as per section (v) of these terms and conditions of booking, it will be deemed that you are confirming your acceptance of this Booking Contract and the important information on behalf of all persons included on the booking which forms the basis of contract between us.

2. PAYING FOR YOUR BOOKING

You must make prepayment to us of any outstanding balance shown on your final invoice at least six weeks prior to the check in date listed on your confirmation invoice or if your booking is made within this period you will be required to pay the full amount immediately to secure your reservation.

If you do not pay in full by the balance due date shown on your confirmation invoice we reserve the right to cancel your booking and you will be liable to pay the cancellation charges as set out in our cancellation policy section of these terms and conditions of booking.

You authorized us to automatically recharge any outstanding balance payments against the credit or debit card that you used to process your original reservation on the due date specified on your confirmation invoice. Should we fail to collect any outstanding funds we reserve the right to cancel your booking and you will be liable to pay the cancellation charges as set out in our cancellation policy section of these terms and conditions of booking.

It is illegal to use somebody else’s credit card to make payments on your behalf without their prior knowledge or consent. Should you wish to use a different persons credit card to make payments, even if they are traveling in your party then we will require a faxed copy of both sides of their credit card and their written authorization to confirm that they are making payments on your behalf.

3. MAKING AMENDMENTS TO YOUR BOOKING INCLUDING NAME CHANGES

If you wish to make any changes to your booking, including name changes, once we have issued your confirmation invoice, but outside the cancellation period outlined in our cancellation policy section, the lead name person on the booking must advise us immediately in writing and we will do our best to help. However, verbal requests will not be accepted and we may not always be able to meet your request and have no obligation to do so. Where it is possible to meet your request, the total booking cost will be recalculated in accordance with any new arrangements taking into consideration any applicable cancellation fees or other charges payable and a new confirmation invoice issued. Unless otherwise agreed in writing, you agree to pay us a non refundable administration fee of $25.00 per booking in addition to a non refundable amendment fee of $25.00 per name change. This must be paid by you at the time of processing your requested amendment.

4. TRANSFERRING YOUR BOOKING

If you are prevented from traveling, you may transfer your booking to another person or group, as long as you give us at least 21 days notice, in writing, and the arrangements remain exactly the same as the original booking. You must also agree to pay any additional charges including administration fees or cancellation charges that we may incur or levy to make this change. The person that you transfer your booking to must comply with all the terms of the existing booking and you will remain responsible for the payment of any outstanding monies should that person fail to pay.

If you wish to transfer your booking to a different accommodation then you may do at an administration charge of $25.00 per booking providing that the cost of the new arrangements is greater than your original reservation costs and is traveling within the same season. If you wish to change your booking arrangements to a property of a lower price value to that of your original reservation then this will be treated as cancellation with loss of deposit and, if applicable, cancellation charges as set out in our cancellation policy section and it will be necessary for you to re-book another accommodation.

5. CANCELLING YOUR BOOKING

If you cancel your booking the lead named person on the booking must advise us in writing, preferably by email, post or facsimile immediately. Verbal cancellations will not be accepted. If you cancel any element of your booking including individual rooms and passengers then you will be liable to pay the full cancellation charges as set out below. Cancellation periods are calculated on the date of your cancellation notification being received by us, in writing at our UK office.

The term ˜total booking costs” in the table means the total booking cost for all persons included on the booking and shown on our invoice, if cancellation occurs prior to the scheduled date of check-in.

1-REFUNDS:

Refunds application should be addressed to World of Travel Inc. within 10 days after completing travel. The changes related purchased services made by customer, is under his responsibility Unused portion of the services are not refunded.

2-CANCELLATIONS on Hotels Tours

Partial cancellation of a previously confirmed booking, must be followed a new confirmation order from World of Travel USA Confirmed the modified booking. Full cancellation of a previously confirmed booking , must be followed by an World of Travel USA will not be responsible for any cancellation not confirmed back to you by World of Travel USA and will regularly Debit the relative no-show charges

a-) Escorted Tours & Cruise:

For cancellation 30 days before arrival: 20% of the total cost

For cancellation from 14 to 7 days prior to arrival: 30%of the total cost

For cancellations from 6 Days 48 hours prior to the arrival: %40 of the package price per person

For cancellation less than 48 hours prior to arrival or no shows %50 of the package price per person

b-) Hotels, Sightseeing, Transfers

For Cancellation 15-8 days before arrival No cancellation fee (if not fair or congress period)

For Cancellation 7-2 days before arrival First night of the hotel charge or the transfer cost or Tour cost

Later Cancellation or No Shows First night of the hotel charge or the transfer cost or Tour cost

If you cancel your holiday on the day of arrival due to circumstances which are beyond our control, compensation or refunds will not be payable by ourselves and any such claims If you cancel your holiday on the day of arrival due to circumstances which are beyond our control, compensation or refunds will not be payable by ourselves and any such claims should be forwarded to your travel insures.

Should you decide to curtail your stay for whatever reason, no refunds will be payable for any unused nights of accommodation. Subject to the other terms of these booking conditions, no refunds will be made in respect of any accommodation or other services which are not used for whatever reason.

6. WHILST IN RESORT

If you wish to make any changes to the booked arrangements whilst in resort, for example upgrading your accommodation, changing resort or extending or reducing your stay, all such requests will be subject to availability and any extra costs, including cancellation charges, administration charges and amendment fees, must be met by you and paid locally.

As this alters the basis of your booking contract it is essential such changes are arranged through us in writing, through our local agent/representative, area office or, if this is not possible, our head office in the USA.

The accommodation booked is only available for use by those persons included on the booking unless otherwise agreed by us in writing. You are responsible for any damage caused to your accommodation, except by persons not known to you or us and unconnected with the contract between us, during your stay and any charges levied by the owner/hotel manager or third party accommodation provider in this respect must be met by you and paid locally.

Please remember that you are a guest at your accommodation and the owner/hotel manager may remove anyone whose behavior is disruptive or affects the enjoyment of other guests.

7. PROBLEMS WHILST OVERSEAS & COMPLAINTS PROCEDURE

In the unlikely event that you have a complaint whilst you are staying at the accommodation you must bring it to the immediate attention of the hotelier or the management staff. This procedure is an E.C. requirement and gives the hotelier the opportunity to resolve your grievance immediately, to a satisfactory conclusion.

If for some reason your complaint cannot be resolved by the hotelier then you must contact the third party accommodation providers local representative by telephoning their emergency local contact numbers that are listed on your accommodation voucher. Providing that your grievance is genuine, the local agent will listen to your complaint sympathetically and try to resolve any problems with the hotelier on your behalf.

In the event that your complaint remains unresolved and you wish to take the matter further then you must do so whilst you are in resort by formally registering your complaint against the hotelier or the third party accommodation provider in writing. Any claims for compensation or recompense must be negotiated and dealt with directly between you and the hotelier or third party accommodation provider listed on your accommodation voucher as per the compensation section of these booking conditions and you agree to indemnify us and our associated companies against any claims of compensation, refund or recompense without exception.

We take ever complaint seriously, therefore should your complaint remain unresolved on your return, after every effort was made by you to adhere to the complaints procedure, and you would like us to act in the capacity of an intermediary in helping you to conclude the matter, then you should write to us within 28 days of your return to allow us to investigate it properly. You will need to provide us with your booking reference number and enclose any supportive documentation that was supplied to you by the hotelier or third party accommodation provider. Upon receipt of your letter and documents we will send you an acknowledgement, investigate the points raised and endeavor to reply within 28 days with our findings or, if this is not possible, send you an interim letter advising of our progress.

8. SPECIAL REQUESTS

We will always pass on any special requests to third party accommodation providers so that they may be passed onto your hotelier on your behalf. However, special requests do not form any basis of the contract with us, are provided at the hotelier’s discretion and cannot be guaranteed.

9. ADMINISTRATION CHARGES

We reserve the right to levy an administration charge in certain circumstances to cover any additional costs incurred by us, such as contacting suppliers to check availability, special requests, returning lost property, special documentation despatch, extra administration relating to requesting that additional rooms be added onto bookings and the re-issue of duplicate documents should they become lost or misplaced by you. This cost is usually $25.00 per booking, but may be higher under certain circumstances.

CREDIT CARD PAYMENTS TERMS

All credit cards must have verifiable billing Address.

We only accept the Traveler’s Credit card online; we do not accept 3rd party credit cards online.

If you wish to use a third party credit card, please email us at info@worldoftravelusa.com This e-mail address is being protected from spam bots, you need JavaScript enabled to view it we will fax you a Credit card Authorization form.

If there is any issue with the Credit card, we will notify you within 24Hrs, by submitting the Credit Card; it automatically does not guarantee “Ticketing”.

You are agreeing to reimburse the commissions back to World of Travel USA if the client/traveler disputes the credit card payments.

You agree to be liable for any and all credit card payments disputes or other problems such as Fraud made to us or the supplier on behalf of your client. You agree to reimburse World of Travel USA is cases of Fraud or Charge backs.

Credit cards with US or Canadian Billing addresses will only be accepted. We do not accept other foreign credit Cards.

You have read the rules and terms of the agreement.

TERMINATION

We reserve the right, in our sole discretion, and without liability, to terminate your access to all or part of the Site, with or without notice, for any reason or no reason.

SCANS

If you abuse the system with numerous scans and not enough Ticketed bookings, we will terminate your agreement immediately.

Baggage Policy On Connecting Flights – when there are 2 airlines involved for connecting flights then you may have to re-claim your bags at Connecting Airport and check in again for onward journey. You are also advised that in these cases if you have excess baggage, you will have to pay this twice, for each airline.

Credit Card Authorization Forms – At times for HIGH RISK transactions such as one way International tickets, Foreign origination tickets, we may need a Credit Card Authorization form to be filled out by the card holder, we do NOT guarantee that the fares may be valid until we recieve the credit card authorization form filled out. At times the tickets may be issued even if we have not received the form back. All issued tickets are NON REFUNDABLE.

AIRLINES SCHEDULE CHANGES

We encourage you to re-confirm your flight schedules with the airlines 72 hours prior to departure. Failing which we advise you to reconfirm your flight schedules at least 24 hours prior to your departure. These days many airlines make schedule changes due to reasons only known to them.

Please note we shall make our best efforts to notify you of any such schedule changes. However it is not a guarantee that we shall be always able to make successful contact with you through phone or e mail to deliver to you such important travel update. We do not own any liability for cancelled flights, flights that are missed or flights mis-connection due to any scheduled changes.

HUMAN ERROR OR CUSTOMER SERVICE AGENT’S ERROR

If any of our agent makes a mistake or any human error is made we shall make every attempt to rectify any such errors. World of Travel USA stands committed to provide compensation up to a maximum of entire service fees that World of Travel USA has collected in addition to a $ 25 free coupon as redemption towards purchases from World of Travel USA in the future.

ITINERARY RE-CONFIRMATION

It is the responsibility of the passenger who has booked with us online or has made booking over phone to review and reconfirm names, dates, flight numbers, airlines, routing including any airport changes are in accordance and acceptance of the passenger. If you discover any discrepancy or you don’t agree, you are requested to immediately contact World of Travel USA over phone not over 4 hours from the time booking is made.

If we don’t hear from you within 4 hours we shall consider the booking you have made is acceptable to you and we don’t hold any liability thereafter for any changes whatsoever.

You are requested to review and save the Itinerary with you.

AUTHORITY TO SEND COMMUNICATION

By approving this transaction you are authorizing World of Travel USA to send you communication in the form of email, postal mail, instant messaging, phone call, text messaging and any other form of electronic or paper communication. This communication will be primarily for customer service and may include special offers from time to time.

10. INDEMNIFICATION

You agree to indemnify and hold each of World of Travel Inc. Inc and its associate or affiliate companies and their officers and employees harmless of any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of this site, or the violation of our terms and booking conditions by you, or the infringement by you, or any other person or persons on your booking, of any intellectual property or other right of any other person or entity.

11. JURISDICTION

This contract is governed by the law of the jurisdiction of the Courts of New York USA

No employee or representative of this company has the authority orally to vary these terms and conditions or the information within this site, or company literature or to enter into verbal agreements with customers of this company.
